By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.
1. Definitions
- Platform — the website, services, tools, and content provided by Lemvark at lemvark.com.
- User — any individual or entity that accesses or uses the Platform.
- Account — a registered profile created by a User to access protected features of the Platform.
- Content — all text, video, audio, images, materials, and data made available through the Platform.
- Service — all features, functionalities, and educational offerings provided through the Platform.
- We / Us / Our — Lemvark and its authorized representatives.
2. Acceptance of Terms
By creating an Account, completing a purchase, enrolling in a learning program, or simply browsing the Platform, you enter into a legally binding agreement with Lemvark under these Terms of Use and any applicable supplemental policies. These Terms apply to all Users regardless of geographic location.
3. Eligibility
- You must be at least 16 years of age to use the Platform independently.
- Users under the age of 16 may only use the Platform with verified parental or guardian consent.
- By using the Platform, you represent and warrant that the information you provide is accurate, current, and complete.
- We reserve the right to suspend or terminate access for any User who does not meet eligibility requirements.
4. Account Registration and Security
4.1 Registration
- Certain features require Account registration. You agree to provide truthful and accurate information during registration.
- Each User may hold only one Account unless expressly authorized otherwise.
- You are responsible for maintaining the confidentiality of your login credentials.
4.2 Account Responsibility
- You are solely responsible for all activity that occurs under your Account.
- You must notify us immediately at help@lemvark.com if you suspect unauthorized access to your Account.
- We are not liable for any loss or damage resulting from unauthorized use of your Account credentials.
5. Permitted Use
The Platform is intended for lawful, personal, and non-commercial educational purposes unless otherwise agreed in writing. You may access and use the Content solely for your own learning and development in connection with transportation-related knowledge provided through Lemvark's programs.
- You may view, stream, and interact with Content made available through your enrolled programs.
- You may download materials only where explicit download functionality is provided.
- You may share publicly available information about the Platform using standard hyperlinking.
6. Prohibited Conduct
You agree not to engage in any of the following:
- Copying, reproducing, distributing, or publicly displaying any Content without prior written authorization.
- Reverse engineering, decompiling, or attempting to extract source code from any part of the Platform.
- Using automated tools, bots, scrapers, or scripts to access or harvest data from the Platform.
- Impersonating another person or entity, or falsely representing your affiliation.
- Uploading or transmitting malicious code, viruses, or any content that could harm the Platform or other Users.
- Engaging in unauthorized commercial activity, including reselling access to Content.
- Circumventing any authentication, access control, or digital rights management mechanisms.
- Using the Platform to harass, threaten, or harm other Users or third parties.
- Violating any applicable local, national, or international law or regulation.
7. Intellectual Property
7.1 Ownership
All Content, trademarks, logos, software, design elements, and materials available on the Platform are the exclusive property of Lemvark or its licensors. Nothing in these Terms transfers any intellectual property rights to you.
7.2 Limited License
Subject to your compliance with these Terms, Lemvark grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its Content for personal educational purposes only.
7.3 User Submissions
If you submit any feedback, comments, or suggestions to the Platform, you grant Lemvark a worldwide, royalty-free, perpetual license to use, reproduce, and incorporate such submissions without any obligation to compensate you.
8. Payments and Subscriptions
8.1 Pricing
- Certain programs and features require payment. All applicable fees are displayed at the point of purchase.
- Prices are subject to change. Changes will not affect existing confirmed purchases.
8.2 Billing
- By completing a purchase, you authorize us to charge the stated amount to your selected payment method.
- All transactions are processed through third-party payment processors. We do not store full payment card details.
8.3 Refunds
- Refund eligibility is subject to the specific terms stated at the time of purchase for each program or service.
- Requests for refunds must be submitted to help@lemvark.com within the stated refund window.
- We reserve the right to decline refund requests where Content has been substantially accessed or downloaded.
9. Third-Party Links and Services
The Platform may contain links to third-party websites, tools, or services. These links are provided for convenience only. Lemvark does not endorse, control, or assume any responsibility for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk.
10. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy. We encourage you to review it before using the Platform.
11. Disclaimers
- The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
- We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- Educational Content is provided for informational purposes only. Lemvark does not guarantee specific outcomes or results from participation in any program.
- We do not warrant the accuracy, completeness, or currentness of any Content on the Platform.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Lemvark and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunity, arising from or related to your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total amount paid by you to Lemvark in the twelve months preceding the event giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless Lemvark and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
14. Suspension and Termination
- We reserve the right to suspend or terminate your Account and access to the Platform at our discretion, with or without notice, if you breach these Terms or engage in conduct that we determine to be harmful to the Platform, other Users, or Lemvark.
- Upon termination, your right to access the Platform and its Content ceases immediately.
- Provisions of these Terms that by their nature should survive termination shall remain in effect, including intellectual property, disclaimers, indemnification, and limitation of liability clauses.
15. Modifications to the Terms
We may update or modify these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. If changes are material, we will make reasonable efforts to notify registered Users via email or through a notice on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
16. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with generally accepted principles of international commercial law. Any disputes arising from or in connection with these Terms shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty days, it shall be submitted to binding arbitration under internationally recognized arbitration rules.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and Lemvark with respect to your use of the Platform and supersede all prior agreements, understandings, and communications on the subject matter.
